These Terms and Conditions set out the basis on which Washed Up ("we", "us", "our") provides website design and management services to you, the client. By engaging our services, signing up to a monthly plan, or setting up a Direct Debit through GoCardless to pay for our services, you confirm that you have read, understood and agree to be bound by these terms.
Washed Up is the trading name of a sole trader based in Essex. You can contact us at washedupstore@gmail.com.
1.Our services
We provide website design, build, hosting and ongoing management on a monthly subscription basis. The specific features included depend on the plan you choose (Starter, Standard or Premium) as described on our website at the time you sign up.
2.Fees and payment
- A one-off setup fee applies to each plan, payable before work begins.
- The monthly fee is payable in advance by Direct Debit, collected through GoCardless on a recurring basis.
- Monthly fees are ongoing for as long as your website is live and managed by us.
- All fees are quoted in pounds sterling.
3.Website ownership and hosting
While you are on a monthly plan, we build, host and manage your website on your behalf. The website remains hosted on our infrastructure for the duration of the agreement. You own the content you provide to us, such as your text, images and logo.
The underlying code, design and build remain the property of Washed Up unless a separate transfer is agreed in writing. If you wish to take ownership of the website files, this can be arranged for an agreed one-off fee.
4.Domain names
If you already own a domain name (such as yourbusiness.co.uk) we will connect it to the website we build for you at no additional charge. You remain the owner of that domain.
If you do not already own a domain name, we will register one on your behalf as part of getting you set up. While you are on a monthly plan with us:
- The domain will be registered and managed under the Washed Up account at our chosen registrar.
- The annual cost of registering and renewing the domain is included within your monthly fee at our discretion. If renewal costs increase, or if a premium domain is required, we may pass these costs on at fair, ordinary commercial rates and will inform you in advance.
- The domain forms part of the package we manage on your behalf and is not transferred to you unless explicitly agreed in writing.
If you wish to take ownership of a domain we have registered on your behalf, this can be arranged for an agreed administration fee, subject to all outstanding fees being paid in full.
5.Your responsibilities
- You agree to provide accurate information and any content needed to build your website in a timely manner.
- You confirm that any text, images or other material you supply does not infringe the rights of any third party.
- You are responsible for ensuring the information on your website is accurate and lawful.
6.Updates and changes
Reasonable updates to your website are included in your monthly plan, with response times depending on your chosen plan. Large new pieces of work, such as a significant redesign or additional functionality beyond your plan, may be quoted separately.
7.Cancellation and removal of services
- You may cancel your plan at any time by giving 30 days' written notice by email.
- Your monthly fee remains payable during the notice period.
- Setup fees, where applicable, are non-refundable once work has begun.
- On cancellation, your website will be taken offline at the end of the paid period unless a separate transfer of ownership has been agreed in writing.
- If a monthly payment fails, is cancelled by you, or remains unpaid for more than 14 days, we reserve the right to suspend or remove your website without further notice, until payment is brought up to date.
- If you materially breach these terms — including but not limited to non-payment, providing unlawful content, or misusing the service — we may suspend or terminate the agreement with immediate effect, and your website will be removed.
- Where we have registered a domain name on your behalf, we may also choose not to renew that domain on expiry following cancellation or termination.
8.Availability
We take care to keep websites online and running smoothly but cannot guarantee uninterrupted availability, as hosting and third-party services are outside our direct control. We will act promptly to resolve any issues that arise.
9.Liability
We provide our services with reasonable care and skill. To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit or loss of business arising from the use of your website. Nothing in these terms limits our liability where it would be unlawful to do so.
10.Third-party services
Your website may rely on third-party services such as hosting providers, domain registrars and payment processors. We are not responsible for the acts, omissions or availability of these third parties, though we will choose reputable providers.
11.Changes to these terms
We may update these Terms and Conditions from time to time. Where changes affect an ongoing agreement, we will give you reasonable notice. The latest version will always be available on this page.
12.Governing law
These Terms and Conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
